Terms of Use

Last updated: [DATE]

These terms govern your use of files.ge (the "Service"), operated by [LEGAL ENTITY NAME], [REGISTERED ADDRESS], Georgia ("we", "us"). By using the Service, or by ticking the acceptance box before creating a link, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What the Service is

Files.ge lets you send files directly from your browser to another person's browser (peer to peer). Files are not uploaded to or stored on our servers. We provide the web app and the connection coordination that make the transfer possible. The sender must keep the page open while the transfer runs; when the sender closes the page, the link stops working. The Service may show advertisements on some of its public pages (never on download pages).

2. Eligibility

You must be at least 16 years old, or have the permission of a parent or guardian, and be legally able to enter into these terms.

3. Your responsibility for what you share

You alone are responsible for the files you send and the files you choose to download. Because files travel directly between users, we cannot see, review, or remove them. You confirm that you have the right to share any file you send and that doing so does not break the law or anyone's rights.

4. Acceptable use

You must not use the Service to send, request, or distribute:

  • content that is illegal in Georgia or in the place where you or the recipient are located, including child sexual abuse material, content that incites violence or terrorism, and non-consensual intimate images;
  • material that infringes copyright, trademarks, or other intellectual property or privacy rights;
  • malware, viruses, or anything designed to damage or gain unauthorized access to a system;
  • harassing, threatening, defamatory, or fraudulent material, or unsolicited bulk messages.

You must also not:

  • interfere with or overload the Service or its infrastructure, or attempt to bypass rate limits or security measures;
  • scan, scrape, or enumerate share links or connection identifiers;
  • use the Service to relay traffic for purposes unrelated to sharing files with another person.

5. Reporting and enforcement

Recipients can report a share using the Report button on the download page. When a share is reported, the sender's session may be ended and the link is disabled. We only count reports per day and record nothing that identifies the reporter or the sender (see the Privacy Policy). We may also, at our discretion and to the extent allowed by law: disable links, limit or block access to the Service (including temporarily, by network address), and cooperate with law enforcement and competent authorities as the law requires. Because we keep no IP addresses or per-transfer records, we generally hold nothing that identifies a sender or recipient. We are not obliged to monitor the Service, and our not acting on something is not approval of it.

6. Privacy

How we handle personal data is described in the Privacy Policy. In particular, please note that in a direct transfer the other person's browser can see your IP address.

7. Risks of downloading files

Files come from other people and are not scanned by us. Only download files from senders you trust, and scan them with up-to-date security software. You are responsible for any harm to your devices or data that results from files you download.

8. No guarantees

The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free, or secure, that a transfer will succeed or complete, or that files will arrive intact. Transfers depend on both users' devices, browsers, and networks, which we do not control. We may change, suspend, or discontinue any part of the Service at any time.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost data, lost profits, or loss of goodwill, arising from your use of the Service, and our total liability to you for any claim relating to the Service is limited to [AMOUNT / ZERO FOR A FREE SERVICE]. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer rights.

10. Indemnity

You agree to compensate us for losses, claims, and costs (including reasonable legal fees) arising from your breach of these terms or from files you share, to the extent permitted by law.

11. Intellectual property

The Files.ge name, logo, design, and software are owned by us or our licensors. These terms give you no rights to them except the right to use the Service as intended. You keep all rights to the files you send; we do not receive or claim any license to them because we never receive them.

12. Termination

You can stop using the Service at any time. We may suspend or end your access, without notice where necessary, if you break these terms or if required by law.

13. Changes to these terms

We may update these terms. The "Last updated" date shows the latest version, and material changes will be announced on the website. Continued use after a change means you accept the updated terms.

14. Governing law and disputes

These terms are governed by the laws of Georgia. Disputes will be resolved by the competent courts of [CITY/COURT], Georgia, without limiting any mandatory rights you have as a consumer under the laws of your country of residence.
